Louisiana and Connecticut tackled some of the most pressing issues facing the 340B program, but each ended with very different results, Slafsky observes. Red state Louisiana passed sweeping legislation that protected 340B contract pharmacy arrangements and outlawed alleged pharmacy benefit manager bias against covered entities. Blue state Connecticut started with an even more ambitious bill but ultimately passed a watered down version that only addressed PBM discrimination.

After detailing the legislative debates and compromises behind each bill, Slafsky notes that the divergent outcomes are a harbinger of the “challenges ahead in getting a national consensus on thorny 340B issues.”
