A key House committee has passed a controversial bill to impose significant reporting requirements on 340B DSH hospitals “and any other covered entity” that the HHS Secretary specifies. The committee also passed a bill to make it harder to earn savings from Medicaid managed care plans and mandates new reporting requirements on Medicaid revenue. Meanwhile, there is a growing consensus among 340B covered entity groups that Congress will need to intervene to end drug manufacturer restrictions on discounts in the contract pharmacy setting. Legislation has also been introduced to protect 340B entities from perceived discriminatory practices by PBMs and other payors.
