Q: Tell us some interesting details about your company’s history.

Powers Law was founded by Galen D. Powers, the first Chief Counsel to the Health Care Financing Administration – the precursor to CMS – marking the start of a legacy deeply rooted in healthcare advocacy and policy.

Since the inception of the 340B program in 1992, Powers has been a trusted leader in helping safety-net providers navigate its complexities. Our 340B practice is built on decades of experience representing a wide range of stakeholders, including hospitals such as disproportionate share hospitals, children’s hospitals, cancer hospitals, and rural hospitals; clinics such as FQHCs, FQHC look-alikes, Ryan White clinics, hemophilia treatment centers, STD clinics, and family planning clinics; and pharmacy-related clients including independent and chain pharmacies, contract pharmacy administrators, pharmaceutical distributors, and pharmacy consultants.

Powers’ 340B attorneys are at the forefront of policy, compliance, litigation, and strategic counsel. Our 340B practice leader, William von Oehsen, played a key role in crafting the original 340B legislation and law as well as significant amendments to the statute under the Affordable Care Act of 2010. From legislative advocacy and audit support to contract negotiation and risk analysis, we are proud to be one of the most comprehensive 340B-focused teams in the country.

Q: What makes your company unique in the 340B space?

At Powers, we offer a 360-degree approach to 340B. From litigation, legislation, and lobbying at both the state and federal levels to transactional matters, contract work, and compliance, there isn’t an aspect of the 340B program we don’t touch. Our team includes former pharmacists, experienced attorneys, and seasoned policy experts who bring both legal and operational insight to every engagement. We work with every type of covered entity, tailoring our approach to meet the unique needs of hospitals, clinics, and pharmacies alike.

Powers has also played a foundational role in the 340B advocacy community. Bill von Oehsen founded the Public Hospital Pharmacy Coalition, which evolved into 340B Health, and our team helped launch key stakeholder groups like RWC-340B and CV340B. Powers has demonstrated its long-standing commitment to protecting and strengthening the program for all who depend on it.

Q: What about your company’s work are you most proud of?

We’re most proud of our long-standing commitment to protecting access to care through thoughtful advocacy, not just representation. We aren’t just representing clients-we’re advocating for solutions.

Our team has been instrumental in advocating for state legislation that protects 340B from unfair shipment restrictions and expands access to care. Our efforts have helped shape and sustain the program for both providers and patients, and we approach every project with the goal of strengthening the safety net and ensuring 340B continues to serve those who need it most.
