The 340B drug discount program continues to receive significant attention on Capitol Hill and in the executive branch. The ranking Republican member of a key Senate committee has opened up an investigation into hospital use of the 340B program. At the same time, an influential bipartisan group of six U.S. Senators is contemplating legislative remedies to address matters such as the contract pharmacy standoff and calls for more transparency and good stewardship. The House is expected to pass a bill to impose significant reporting requirements on 340B DSH hospitals “and any other covered entity” that the HHS Secretary specifies. It would also require 340B providers to bill Medicaid managed care plans at acquisition cost or report their Medicaid revenue to the government. Meanwhile, stakeholders are proposing various solutions to address contract pharmacy restrictions and surprising coalitions are forming. This includes the possibility of a new program called 340C.
